2. تعريف البيانات الشخصية

يقصد بـ "البيانات الشخصية" أي معلومات ـ مهما كان مصدرها أو شكلها ـ تؤدي إلى تحديد هوية شخص طبيعي بصورة مباشرة أو غير مباشرة، أو تجعل التعرف عليه ممكنًا، ويشمل ذلك ـ على سبيل المثال لا الحصر ـ الاسم، ورقم الهوية الوطنية أو أي رقم تعريفي، ورقم الهاتف المحمول، والبريد الإلكتروني، والعنوان الوطني، وعنوان بروتوكول الإنترنت (IP)، وأي معلومات أخرى تُعد بيانات شخصية وفقًا للأنظمة واللوائح المعمول بها.

3. نطاق تطبيق السياسة

تسري سياسة الخصوصية هذه على جميع البيانات الشخصية التي تجمعها شركة عددكم التجارية من خلال:

• الموقع الإلكتروني للشركة.
• تطبيقات الهاتف المحمول (إن وجدت).
• الفروع وصالات العرض.
• قنوات خدمة العملاء.
• المراسلات عبر البريد الإلكتروني.

قد تتم معالجة بيانات الدفع من قبل مزودي خدمات الدفع المعتمدين لدى الشركة. ولا تحتفظ الشركة ببيانات بطاقات الدفع كاملة إلا إذا كان ذلك مسموحًا به بموجب الأنظمة واللوائح المعمول بها.

• الاهتمامات.
• الردود على الاستبيانات.
• التفاعل مع الرسائل والحملات التسويقية.

5. كيفية جمع البيانات الشخصية

تقوم الشركة بجمع البيانات الشخصية من خلال:

• إنشاء حساب.
• تقديم طلب شراء.
• التواصل مع خدمة العملاء.
• زيارة فروع الشركة.
• التسجيل في العروض أو الحملات الترويجية.

6. مسؤول التحكم في البيانات (Data Controller)

لأغراض تطبيق نظام حماية البيانات الشخصية (PDPL) في المملكة العربية السعودية، وأحكام سياسة الخصوصية هذه، تُعد شركة عددكم التجارية هي المتحكم في البيانات الشخصية (Data Controller)، وهي الجهة المسؤولة عن تحديد أغراض ووسائل معالجة البيانات الشخصية، وضمان معالجتها بما يتوافق مع الأنظمة واللوائح المعمول بها.

7. الأساس النظامي لمعالجة البيانات الشخصية

تعالج الشركة بياناتكم الشخصية استنادًا إلى أساس نظامي واحد أو أكثر من الأسس التالية:

• تنفيذ عقد تكونون طرفًا فيه، أو اتخاذ الإجراءات اللازمة بناءً على طلبكم قبل إبرام العقد.
• الامتثال للالتزامات النظامية والتنظيمية المطبقة.
• الحصول على موافقتكم الصريحة، متى كان ذلك مطلوبًا بموجب الأنظمة.
• تحقيق المصالح المشروعة للشركة، شريطة ألا تتعارض تلك المصالح مع حقوقكم وحرياتكم الأساسية.
• حماية المصالح الحيوية في الحالات التي تجيزها الأنظمة واللوائح المعمول بها.

8. أغراض معالجة البيانات الشخصية

تستخدم الشركة بياناتكم الشخصية لتحقيق الأغراض التالية:

• إنشاء وإدارة حسابكم.
• معالجة الطلبات وتنفيذها.
• إصدار الفواتير.
• معالجة المدفوعات.
• إدارة خدمات الضمان وطلبات الإرجاع.
• تقديم خدمات الدعم الفني وخدمة العملاء.
• تحسين المنتجات والخدمات التي تقدمها الشركة.
• تخصيص تجربة التسوق بما يتناسب مع تفضيلاتكم.

9. مشاركة البيانات الشخصية

قد تقوم الشركة بمشاركة بياناتكم الشخصية مع الجهات التالية عند الحاجة وللأغراض المشروعة:

• شركات الشحن والخدمات اللوجستية.
• مزودي خدمات الدفع.
• مزودي خدمات الاستضافة والحوسبة السحابية والبنية التحتية التقنية.
• مزودي خدمات الرسائل النصية القصيرة (SMS) والبريد الإلكتروني.
• الجهات الحكومية أو التنظيمية المختصة متى كان ذلك مطلوبًا بموجب الأنظمة.
• مزودي خدمات التحليلات وقياس الأداء.
• مزودي خدمات الدعم الفني.

ولا تقوم الشركة ببيع بياناتكم الشخصية لأي طرف ثالث تحت أي ظرف.

وتلتزم جميع الجهات التي تتلقى البيانات الشخصية من الشركة بموجب اتفاقيات تعاقدية تلزمها بالحفاظ على سرية البيانات والامتثال لأنظمة حماية البيانات الشخصية والأنظمة ذات العلاقة.

10. ملفات تعريف الارتباط (Cookies)

يستخدم الموقع الإلكتروني للشركة ملفات تعريف الارتباط (Cookies) والتقنيات المشابهة بهدف تحسين تجربة التصفح، وتعزيز وظائف الموقع وأمنه، وفهم كيفية تفاعل الزوار مع خدماتنا الإلكترونية.

يمكنكم إدارة ملفات تعريف الارتباط أو تعطيلها في أي وقت من خلال إعدادات المتصفح أو أدوات إدارة ملفات تعريف الارتباط المتاحة. ومع ذلك، قد يؤدي تعطيل بعض ملفات تعريف الارتباط إلى التأثير في وظائف الموقع أو أدائه أو إتاحة بعض الخدمات.

11. أمن البيانات

تطبق الشركة التدابير الفنية والتنظيمية المناسبة لحماية البيانات الشخصية من الوصول غير المصرح به، أو الاستخدام غير المشروع، أو الإفصاح، أو التعديل، أو الإتلاف، وتشمل هذه التدابير على سبيل المثال لا الحصر:

• تشفير البيانات المنقولة عبر الإنترنت باستخدام بروتوكولات SSL/TLS.
• حماية الخوادم وأنظمة الشركة بواسطة جدران الحماية (Firewalls).
• استخدام أنظمة كشف ومنع الاختراق (Intrusion Detection and Prevention Systems).
• تطبيق آليات التحكم في صلاحيات الوصول إلى البيانات.
• تسجيل ومراقبة عمليات الوصول إلى الأنظمة (Audit Logs).
• إجراء نسخ احتياطية دورية للبيانات.
• تنفيذ تقييمات ومراجعات أمنية بشكل دوري.
• تدريب الموظفين على مبادئ حماية البيانات والخصوصية وأفضل الممارسات الأمنية.

ورغم التزام الشركة بتطبيق التدابير الأمنية المناسبة، فإنه لا يمكن ضمان أن تكون أي وسيلة لنقل البيانات عبر الإنترنت أو أي وسيلة للتخزين الإلكتروني آمنة بشكل كامل بنسبة (100%).

12. حقوق أصحاب البيانات الشخصية

وفقًا لأحكام نظام حماية البيانات الشخصية (PDPL) والأنظمة واللوائح ذات العلاقة، قد تتمتعون بالحقوق التالية فيما يتعلق ببياناتكم الشخصية:

• الحق في معرفة الأساس النظامي والغرض من جمع بياناتكم الشخصية ومعالجتها.
• الحق في الوصول إلى بياناتكم الشخصية المحتفظ بها لدى الشركة.
• الحق في الحصول على نسخة من بياناتكم الشخصية بصيغة مقروءة وشائعة الاستخدام، متى كان ذلك ممكنًا ومسموحًا به نظامًا.
• الحق في طلب تصحيح أو استكمال أو تحديث البيانات الشخصية غير الدقيقة أو غير المكتملة أو غير المحدثة.
• الحق في طلب حذف البيانات الشخصية أو إتلافها أو إخفاء هوية أصحابها، متى كان ذلك جائزًا بموجب الأنظمة.
• الحق في طلب تقييد معالجة البيانات الشخصية في الحالات التي يسمح بها النظام.
• الحق في سحب موافقتكم في أي وقت إذا كانت المعالجة تستند إلى موافقتكم، دون أن يؤثر ذلك على مشروعية المعالجة التي تمت قبل سحب الموافقة.
• الحق في الاعتراض على بعض عمليات معالجة البيانات الشخصية في الحالات التي يجيزها النظام.
• الحق في تقديم شكوى إلى الجهة المختصة إذا اعتقدتم أن بياناتكم الشخصية تمت معالجتها بما يخالف الأنظمة أو اللوائح المعمول بها.

وتخضع ممارسة هذه الحقوق لما قد تفرضه الأنظمة واللوائح المعمول بها من قيود أو استثناءات نظامية.

13. كيفية ممارسة حقوقكم

يمكنكم ممارسة حقوقكم المتعلقة بالخصوصية من خلال التواصل مع مسؤول الخصوصية لدى الشركة باستخدام بيانات التواصل الواردة في سياسة الخصوصية هذه.

ستقوم الشركة بمراجعة الطلب ومعالجته والرد عليه خلال المدد الزمنية المحددة في الأنظمة واللوائح المعمول بها.

14. الاحتفاظ بالبيانات الشخصية

تحتفظ الشركة بالبيانات الشخصية فقط للمدة اللازمة لتحقيق الأغراض المبينة في سياسة الخصوصية هذه، أو لتقديم منتجاتها وخدماتها، أو لتنفيذ الالتزامات التعاقدية، أو للامتثال للأنظمة واللوائح المعمول بها في المملكة العربية السعودية.

ويجوز الاحتفاظ بالبيانات الشخصية لمدة أطول عند الضرورة من أجل:

• الامتثال للالتزامات النظامية أو التنظيمية أو الضريبية أو المحاسبية أو متطلبات التدقيق أو إعداد التقارير.
• تسوية النزاعات أو إنفاذ الحقوق والالتزامات التعاقدية.
• منع الاحتيال أو إساءة الاستخدام أو الأنشطة غير المصرح بها أو الحوادث الأمنية.
• الاحتفاظ بسجلات الضمان وخدمات ما بعد البيع والدعم الفني.
• حماية الحقوق النظامية والمصالح المشروعة للشركة.
• الالتزام بمدد الاحتفاظ التي تفرضها الأنظمة واللوائح ذات العلاقة.

وعند انتهاء مدة الاحتفاظ النظامية، وعدم وجود حاجة مشروعة للاحتفاظ بالبيانات الشخصية، ستقوم الشركة بحذفها أو إتلافها أو تحويلها إلى بيانات مجهولة الهوية بصورة نهائية، باستخدام التدابير الفنية والتنظيمية المناسبة، ما لم يكن الاحتفاظ بها لفترة أطول مطلوبًا أو مسموحًا به بموجب الأنظمة.

كما تقوم الشركة بمراجعة البيانات الشخصية التي تحتفظ بها بصورة دورية للتأكد من عدم الاحتفاظ بها لمدة تتجاوز ما تقتضيه الأغراض التي جُمعت من أجلها، مع استمرار تطبيق جميع الضمانات الأمنية المناسبة طوال مدة الاحتفاظ بها.

15. الرسائل التسويقية

ترسل الشركة الرسائل التسويقية فقط وفقًا للأنظمة واللوائح المعمول بها.

ويحق لكم إلغاء الاشتراك في الرسائل التسويقية في أي وقت من خلال:

• النقر على رابط إلغاء الاشتراك (Unsubscribe) المرفق في الرسائل التسويقية.
• تحديث تفضيلات الحساب الخاصة بكم.
• التواصل مع خدمة العملاء.

16. البيانات الشخصية الخاصة بالأطفال

لا تستهدف خدمات الشركة الأطفال، ولا تقوم الشركة بجمع البيانات الشخصية الخاصة بالأطفال عن علم، إلا بعد الحصول على موافقة أحد الوالدين أو الولي النظامي، أو في الحالات التي تجيزها الأنظمة واللوائح المعمول بها.

17. اتخاذ القرارات الآلية

قد تستخدم الشركة تقنيات أو أدوات آلية لتحسين تجربة المستخدم، بما في ذلك تقديم توصيات المنتجات واكتشاف عمليات الاحتيال.

ومع ذلك، لا تعتمد الشركة بشكل حصري على أي قرار آلي يترتب عليه أثر قانوني أو تأثير جوهري مماثل على الأفراد دون إجراء مراجعة بشرية مناسبة، متى كان ذلك مطلوبًا بموجب الأنظمة.

18. نقل البيانات الشخصية خارج المملكة

عند الضرورة لتحقيق الأغراض الموضحة في سياسة الخصوصية هذه، يجوز للشركة معالجة بياناتكم الشخصية أو نقلها إلى مزودي خدمات أو جهات تابعة تقع خارج المملكة العربية السعودية، بما في ذلك مزودو خدمات الاستضافة السحابية، والبنية التحتية التقنية، وخدمات الاتصالات، والتحليلات، والدعم الفني، أو غيرهم من مزودي الخدمات.

ويتم أي نقل دولي للبيانات الشخصية فقط إذا كان مسموحًا به بموجب نظام حماية البيانات الشخصية (PDPL) والأنظمة واللوائح ذات العلاقة، وبعد تطبيق الضمانات المناسبة التي تكفل توفير مستوى كافٍ من الحماية لبياناتكم الشخصية.

وعند الاقتضاء، تضمن الشركة إبرام الترتيبات التعاقدية المناسبة، وتطبيق التدابير التنظيمية والفنية اللازمة قبل نقل البيانات الشخصية خارج المملكة العربية السعودية.

وتظل الشركة ملتزمة بحماية سرية بياناتكم الشخصية وسلامتها وأمنها، بغض النظر عن الدولة التي تتم فيها معالجتها أو تخزينها.

19. الإبلاغ عن حوادث اختراق البيانات الشخصية

في حال وقوع حادث اختراق أو خرق أمني يؤثر على سرية أو سلامة أو أمن بياناتكم الشخصية، ستتخذ الشركة جميع الإجراءات اللازمة التي تفرضها الأنظمة واللوائح المعمول بها، بما في ذلك إشعار الجهات المختصة، وإبلاغ أصحاب البيانات المتأثرين متى كان ذلك واجبًا نظامًا.

20. التعديلات على سياسة الخصوصية

تحتفظ الشركة بحق تعديل أو تحديث سياسة الخصوصية هذه في أي وقت، بما يتوافق مع المتطلبات النظامية أو احتياجات العمل.

وسيتم نشر النسخة المحدثة على الموقع الإلكتروني للشركة مع بيان تاريخ آخر تحديث، ويصبح أي تعديل نافذًا اعتبارًا من تاريخ نشره، ما لم يُنص على خلاف ذلك.
