General Terms of Sale, Returns, Exchanges & Warranty
Edadcom Trading Company
These Terms set out the general conditions governing Edadcom sales and services according to the nature of the transaction and sales channel, while preserving all mandatory statutory Customer rights.
Full Terms
These Terms and Conditions apply to the sales and services of Edadcom Trading Company according to the nature of the transaction and the sales channel used. Certain transactions or orders may be subject to specific terms agreed with the Customer; those specific terms apply to the relevant transaction to the extent permitted by law. If any provision conflicts with a mandatory statutory requirement, the mandatory requirement prevails.
1Purchases, Returns & Exchanges
1Proof of Purchase
An invoice, order number, or other accepted proof of purchase must be provided when requesting a return, exchange, or warranty service. The Company may verify the purchase through its systems where sufficient information is available.
2Returns
Edadcom permits products to be returned within 7 days, subject to these Terms. For electronic sales, the applicable statutory period is calculated from the date the Customer receives the Product in accordance with applicable e-commerce provisions. For other sales, the Company return policy applies from the invoice or receipt date, depending on the nature of the transaction, without limiting any mandatory statutory right.
For a discretionary return to be accepted, the Product must generally meet the following conditions:
- Unused and not otherwise used or benefited from.
- In its original and sound condition.
- Free from damage, scratches, or signs of installation or operation caused by the Customer.
- Complete with all included parts, accessories, and manuals.
- Accompanied by the original packaging where reasonably possible and appropriate to the nature of the Product.
- No condition will be applied in a manner that unlawfully removes a mandatory Customer right.
3Exchanges
A Product may be exchanged within 7 days, subject to the same basic conditions applicable to returns and to the availability of the replacement Product. If the replacement Product is unavailable, the Customer may, depending on the circumstances, wait for availability or request a return where the applicable return conditions are satisfied.
4Used or Installed Products
A discretionary return or exchange may be declined where the Product has been used, operated, installed, or otherwise used in a manner that affects its condition, unless the request arises from a defect, non-conformity, or another mandatory statutory right.
Opening the packaging alone does not automatically remove a statutory right where opening was reasonably necessary to inspect the Product, depending on the circumstances.
5Defective, Damaged or Non-Conforming Products
Where a Product is verified to fall within one of the following cases, the matter will be handled according to the nature of the issue and applicable statutory rights, and may include repair, replacement, return, or refund of amounts due.
- The Product is defective.
- The Product does not conform to the agreed specifications.
- The Product is different from the Product ordered.
- The Product is materially incomplete.
- The Product was damaged due to a fulfillment or shipping error for which the Company is responsible.
- The Customer will not bear return costs arising from a verified error for which the Company is responsible.
- The Company may require inspection or a technical report where reasonably necessary to determine the cause of a fault or damage.
6Exceptions
Statutory exceptions apply according to the nature of the Product and transaction. These may include, where legally applicable, Products manufactured or prepared specifically at the Customer's request or according to specifications determined by the Customer, unless the Product is defective or does not conform to the agreed specifications.
A discretionary return may also be declined where damage results from the Customer's misuse, improper possession, installation, or handling. No exception shall be interpreted in a manner that removes a mandatory statutory right.
7Inspection of Returned Products
Returned or exchanged Products may be inspected before final approval to verify the Product condition, the reason for the request, any use or installation, damage or missing components, completeness of parts and accessories, and the cause of a technical fault where relevant.
Receipt of a returned Product by the Company does not constitute final approval of the return before inspection has been completed. Where inspection establishes that damage or a fault resulted from misuse, incorrect installation, improper storage, or Customer negligence, the request may be declined to the extent permitted by law.
8Return Costs
Where a return results from a verified defect or error for which the Company is responsible, the Company will bear the related return cost. Where the Customer elects to return a Product without a defect or Company error, the Customer may bear the direct cost of returning the Product to the extent permitted by applicable law.
No undisclosed or unlawful administrative fee will be imposed.
9Refunds
Once a return is approved, amounts due will be processed within up to 14 business days. Where possible, the refund will be made to the original payment method or through another legally appropriate method according to the payment method and nature of the transaction.
Banks, card issuers, and payment service providers may require additional time to reflect the amount after Edadcom has processed the refund. Required accounting and tax documents relating to a return will be issued in accordance with applicable requirements.
10Discounts and Promotions
Products sold under discounts or promotions are subject to the disclosed terms of the relevant promotion, provided that those terms do not remove any mandatory statutory Customer rights. The fact that a Product was discounted does not by itself remove applicable statutory rights.
2Warranty & Service
11Warranty
Products are subject to applicable statutory warranties and the warranty terms of the manufacturer, authorized agent, or supplier according to the type and nature of the Product.
For electrical and electronic appliances subject to the applicable Saudi requirements, the warranty period shall be at least two years, unless a longer statutory, manufacturer, or authorized-agent warranty applies.
Warranty details may differ according to the brand, nature of the Product, manufacturer or authorized agent, and the warranty period shown on the invoice, Product information, or warranty documentation. Mandatory Customer rights remain unaffected.
12Warranty Exclusions
To the extent permitted by law, warranty coverage may not extend to faults or damage caused by the following where they are the cause of the fault:
- Misuse.
- Negligence or improper storage.
- Accidents or external impact.
- Failure to follow manufacturer instructions.
- Incorrect electrical supply.
- Improper installation.
- Use of unsuitable parts or accessories.
- Tampering with or modifying the Product.
- Unauthorized repairs or maintenance.
- Normal consumption of consumable parts according to their nature, unless a manufacturing defect exists.
- A technical inspection may be used to establish the cause of a fault where necessary.
13Warranty Claims
Proof of purchase and the Product must be provided together with information reasonably required to inspect the claim. A Product may be referred to the manufacturer, authorized agent, or authorized service center where required by the nature of the warranty.
Warranty and maintenance periods will be calculated and extended where required by applicable law.
14Products Submitted for Service or Inspection
Once inspection or maintenance is completed, the Customer will be notified using the contact information recorded with the Company. The Customer should collect the Product within a reasonable period following notification.
Where the Product remains uncollected despite notification, the Company may take lawful measures permitted in relation to storage, safekeeping, or further handling of the Product. Failure to collect a Product does not by itself constitute abandonment of ownership except as provided by applicable law.
3Customer Information, Special Orders & Invoices
15Accuracy of Customer Information
The Customer is responsible for providing accurate information, including name, contact information, delivery address, billing information, and Product specifications supplied for special orders.
To the extent permitted by law, the Company is not responsible for consequences directly resulting from inaccurate information supplied by the Customer.
16Special Orders and Specifications
The Customer is responsible for confirming that a Product is suitable for the intended purpose where the selection is based on specifications or measurements supplied by the Customer. Where the Company provides an express and specific technical recommendation regarding suitability for a particular purpose, responsibility shall be determined according to the agreed terms and applicable law.
Products specially ordered or prepared for a Customer may be subject to additional terms disclosed at the time of ordering.
17Invoices
Invoices and tax documents are issued in accordance with applicable requirements. An original electronic invoice will not be deleted or amended in a manner contrary to electronic-invoicing requirements. Where a lawful adjustment is required, it will be made through a credit note, debit note, or other appropriate statutory document.
4Electronic Sales & Force Majeure
18Electronic Sales
Sales completed through www.edadcom.com or Edadcom applications are subject to the mandatory provisions of the Saudi E-Commerce Law and other applicable regulations.
This includes, where the statutory conditions apply, the Customer right to rescind an electronic contract within the seven days following receipt of the Product, provided that the Product has not been used or otherwise benefited from, and subject to statutory exceptions.
The Shipping and Delivery Policy and Privacy Policy published on the Edadcom online store also apply to electronic sales.
19Force Majeure
The Company shall not be responsible for delay or non-performance directly caused by circumstances outside its reasonable control where those circumstances constitute force majeure or another legally recognized impediment, without prejudice to mandatory Customer rights.
5Liability, Governing Law & Updates
20Limitation of Liability
To the extent permitted by applicable law, the Company is not responsible for losses resulting from misuse of a Product, use for a purpose for which the Product was not designed, installation or operation contrary to instructions, incorrect information or specifications supplied by the Customer, or unauthorized modification or repair where any of those circumstances caused the damage.
Nothing in this provision excludes liability arising from the Company's own fault, a Product defect, or any liability that may not lawfully be excluded.
21Governing Law and Disputes
These Terms are governed by the laws and regulations in force in the Kingdom of Saudi Arabia. The Company will seek to resolve complaints and disputes amicably through Customer Service.
Where an amicable resolution cannot be reached, jurisdiction shall lie with the courts or competent authorities in accordance with the applicable jurisdiction rules of the Kingdom of Saudi Arabia.
22Mandatory Law and Specific Terms
If any provision of these Terms conflicts with a mandatory statutory requirement, the mandatory requirement will apply without affecting the remaining provisions.
Certain transactions may be subject to specific written terms, quotations, or separate agreements. Those specific terms shall apply to the relevant transaction to the extent permitted by law.
23Updates
Edadcom may update these Terms where necessary to reflect regulatory or operational changes. Updates apply from their publication date and will not affect rights or obligations arising before that date except where permitted by law.
